World We Made is the trading name of Gilderton Company Limited, a company incorporated in Hong Kong whose registered office is situated at 8/F, China United Center, 28 China United Centre, North Point, Hong Kong.

The website of World We Made (“the Site”) and its related service (collectively “the Service” or “the Services”) are made available to you in accordance with the following terms of use and service and any other rules posted on the Site (collectively “the Terms and Conditions”). Please read the Terms and Conditions carefully before placing any orders on http://wwm.world. By using the Services you are agreeing to all the Terms and Conditions.

This agreement does not acknowledge any relationship between you and World We Made. It does not entitle you to hold yourself as a representative of World We Made.

World We Made reserves the right to modify the Terms and Conditions from time to time without any prior notice. Please read the Terms and Conditions and check back often. If you do not agree with any of the changes to the Terms and Conditions then you must immediately stop using the Site. Any change made after you have placed an order will not affect that order unless we are required to make such changes by law.

  1. REGISTRATION

    To use some of the services or features made available to you on the Site, you will need to register. In registering an account you agree to provide information of yourself that is true, accurate, current and complete in all aspects. If you are under 18, you must inform your parents or guardian on our Privacy Policy before you register to use the Site and the Services. World We Made reserves the right to only accept orders from individuals that are 18 years old or above.

    In using the Site, you agree to accept responsibility for all activities conducted through your account. The account password you provide should be unique and kept secure, and you must notify World We Made immediately of any breach of security or unauthorized use of your account at the following email address, customercare@wwm.world

    Should any of your registration information change, please notify us immediately at the following email address, customercare@wwm.world. We may change the registration requirements from time to time without any prior notice. Please refer to our Privacy Policy for more information on how we use your personal data.

  2. ELIGIBILITY TO PURCHASE

    In order to place orders with World We Made, you will be required to provide your personal details and information (including but not limited to your real name, phone number, email address and other requested information as indicated). You will also be required to provide payment details that you represent and warrant as both valid and correct and confirm that you are the person referred to in the billing information provided.

    You must meet our conditions of eligibility before placing any order:-

    1. Be aged 18 years old or above; and
    2. Be in the possession of a valid credit / debit card issued by a licensed bank acceptable to World We Made for payment or be in the possession of a valid PayPal account.

    In placing an order with us, you expressly authorize World We Made to process a charge or charges on your credit / debit card or PayPal account in the amount of the total purchase price of your order. You also expressly authorize World We Made to use the personal information provided by you to perform appropriate and necessary anti-fraud checks, credit checks or to authenticate your identity. You also expressly authorize us to transmit or obtain information about you to or from third parties, including but not limited to, credit reference or fraud-prevention agencies, which may keep a record of such information. Please refer to our Privacy Policy for more information on how we use your personal data.

    Products purchased by you are for personal or gift use only and should not be re-sold, used for commercial purposes or any other commercial benefit. World We Made reserves the right to restrict multiple quantities of an item being shipped or delivered to any one particular customer or postal address.

    All orders are subject to stock availability and confirmation of the order price. Items in your shopping basket are not reserved and may be purchased by other customers.

    World We Made will store a record of your transactions for at least a minimum of one (1) year.

  3. ORDERS

    We may be waiting for shipment from our designers or suppliers and consequently you may from time to time be given the possibility of making advance purchases of certain items by making advance payments thereof. This will ensure that you receive your purchased items in priority once the stock has been delivered to us. We will only take advance purchase orders for stock that has been scheduled for delivery by a designer or supplier. Your rights regarding advance purchases are the same as those for any other purchase at World We Made.

    Items received into stock may be pre-allocated to satisfy advance payment orders and customers making advance payments will receive items in priority over customers on the waiting list or customers ordering through the Site for immediate delivery.

    We may be unable to deliver selected advance payment products or merchandise due to production problems or quantity check issues identified when we receive an order into stock. We shall notify you by way of email and refund the advance payment received by us to your credit / debit card or PayPal account within thirty (30) days of advising you that the product or merchandise has become unavailable.

  4. PRICING POLICY

    Prices are shown on the Site in Hong Kong Dollars (HKD$).

    If your credit/debit card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

    Prices displayed on the Site at the time your order is accepted will be honored except in the case of obvious errors. Whilst every effort is made to make sure details on our website are accurate, errors may be discovered from time to time in the pricing of products. We do not guarantee that such products will be error-free and reserve our right to rectify any error discovered.

    If we discover an error in the pricing of a product in your order, we shall notify you as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If we are unable to contact you, we will treat the order as cancelled. If you have already paid for the goods, we shall refund you the full amount received by us as soon as practicable. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

  5. ACCEPTANCE OF YOUR ORDER

    Once you have placed your order on the Site, we shall send you an email in acknowledgement of the receipt of your order. This email does not constitute as an acceptance of your order and it is merely a confirmation of the receipt of your order.

    Acceptance of your order and completion of the contract between you and World We Made will be completed once we have sent you an email to confirm that the goods have been dispatched to you. Only the goods listed in the confirmation email sent at the time of dispatch are included in the contract formed. The sale contract is therefore concluded in Hong Kong and the language of the contract is English.

    World We Made reserves its rights not to accept your order for any reason at its sole discretion. World We Made shall not accept your order for, including but not limited to, the following reasons:-

    1. You do not meet the eligibility criteria set out within the Terms and Conditions;
    2. We are unable to obtain authorization for payment;
    3. The item ordered is out of stock or is withdrawn due to failure to satisfy our quality control standards;
    4. Shipping restrictions apply to one or all of the ordered items; and
    5. We identify a pricing or product description error.

    We will not be liable to you or any third party by reason of us withdrawing any merchandise from the Site whether or not such merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

  6. PAYMENT

    We accept payments by Paypal, which may be clearly advertised on the Site from time to time.

    By placing an order using one of the above online payment methods, you confirm that the PayPal account is yours or that you have been specifically authorized by the owner of the said PayPal account to use the same. All credit / debit card holders are subject to validation checks and authorization by the card issuer. If your card issuer refuses to authorize payment to World We Made, we will not be liable for any delay or non-delivery regarding the items ordered.

    We take reasonable care, in so far as it is in our power to do so, to keep and operate a secure payment process. If you have registered an account on the Site and have decided to save your card details with us, your details will be fully encrypted and solely used to process card transactions that you have initiated and securely stored on our systems. In the absence of negligence on our part, we shall not be liable for any loss you may suffer from as a result of any third party procuring unauthorized access to any data provided by you when using our Services.

    We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we shall not be held liable for any loss you may suffer from as a result of a third party procuring unauthorized access to any data provided by you when accessing or ordering from the Site.

  7. INSURANCE AND DELIVERY

    All delivery times listed on this website is to be used as a guide only and we cannot guarantee that such estimate must be met and we are not responsible for any delay caused by destination customs clearance processes.

    World We Made insures each purchase during the time when it is in transit until it is delivered to your specified delivery address. You are required to sign a confirmation of receipt of the products, at which point responsibility for your purchased goods or items shall pass to you. If the specified recipient is not the original purchaser (for example, when the item concerned has been purchased as a gift) then you accept that evidence of a signature by the specified recipient is evidence of delivery and fulfillment by World We Made. You also accept the associated transfer of responsibility in the same way.

    World We Made provides free shipping on all orders delivering to Hong Kong SAR, Taiwan, Macau and China.

    World We Made provides free shipping delivering to Japan, Malaysia, Singapore, South Korea, Thailand & Vietnam on all orders equal to or above HK$1,501 (after discounts and vouchers have been applied). Orders under HK$1,501 will be subjected to a shipping fee of HK$50.

    World We Made provides free shipping delivering to Australia, Canada, Europe, United States of America and all countries not listed above on all orders equal to or above HK$1,501 (after discounts and vouchers have been applied). Orders under HK$1,501 will be subjected to a shipping fee of HK$150.

  8. RETURNS AND EXCHANGE

    If for any reason you are not satisfied with your purchase, you can return your order for a full refund or exchange within forteen(14) days from the purchase date, except products marked with ‘not eligible for exchanges / returns’ when purchased.

    We only accept items which are unused and with all the World We Made and designer garment tag still attached and the same must be returned in the original undamaged box and/or packing.

    We will not accept damaged or soiled items. Under such circumstance, the refund or exchange will be refused and we shall send the items back to the customer.

    We will not be able to provide a refund on any shipping fees charged for the original order, unless the shipped product is defected.

    We only accept exchange of items for a different size, based on the stock availability. Shipping for replacement item is complementary, but exchanges made to destination outside Hong Kong Special Administrative Region will be processed for customs clearance and therefore any relevant import duty and tax charge will apply. Exchange of items are subject to product availability.

  9. PROHIBITIONS AND FAILURE TO COMPLY

    World We Made reserves the right at its sole discretion to take actions against your account for activities, including but not limited to, using any technology to attempt to hide the use of multiple accounts or disrupt any of our Services in any way.

    World We Made reserves the right to take actions to prohibit you from using your account, not to publish or to remove any comment that will initiate communications which, including but not limited to, those we believe to be unlawful, defamatory, racist or libelous, incite hatred or violence, detrimental to people, institutions, religions or to people’s privacy, causing harm to minors, detrimental to the trade marks, patents and copyrighted content, containing personal data, improperly using the media for promoting and advertising businesses. World We Made reserves the right to terminate any account at its sole discretion for impersonating others or providing any kind of false information. We shall send you an email to inform you of the termination of your account in such event.

    If we consider that you are or have been engaged in prohibited activities are or have been disrespectful towards other users or otherwise have violated the Terms and Conditions, we may deny your assess to the Site on a temporary or permanent basis at its sole discretion.

  10. INTELLECTUAL PROPERTY

    All software and contents of the Site (including but not limited to any text, audio or music, video, graphics, photographs and images) are the intellectual property of World We Made and are protected by intellectual property and copyright laws as well as international treaty provisions. Your use of the Site and its contents grants no right to you in relation to any copyright, design, trademark and all other intellectual property and material rights in relation to the contents of the Site.

    The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the software and contents of the Site is only permitted when express authority is given by World We Made and/or third party licensors in writing. Any reproduction or redistribution of the abovementioned software and contents of the Site is prohibited and may result in civil and/or criminal penalties.

    We reserve the right to withdraw or amend any item of Services without any prior notice and we shall not be liable if for any reason the Site is unavailable at any time and for any period.

  11. THIRD PARTY SITES

    The Site may include hyperlinks to other websites or resources that are operated by parties other than World We Made, including advertisers. World We Made has not reviewed and shall not review any or all of the sites linked to its website and shall not be responsible for the contents or accuracy of any offsite pages.

    We are not responsible for the availability of such offsite websites or resources, and we do not endorse and are not responsible or liable, either directly or indirectly, for the privacy practices or the contents of such offsite websites or resources, including but not limited to any advertising, product or other materials or services on or available from such offsite websites or resources.

    We are not responsible for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such contents, goods or services available on such offsite websites or resources.

    The usage of these offsite websites or resources will be at your own risk and subject to the terms of use and service contained within each of those offsite websites or resources.

  12. YOUR RIGHTS

    Nothing in the Terms and Conditions is intended to affect your rights under the law of Hong Kong Special Administrative Region.

  13. LIABILITY

    We shall not be liable to you or be deemed in breach of these provisions of the Terms and Conditions by reason of any delay in performing, or any failure to perform any of the respective obligations under these provisions of the Terms and Conditions, if the delay or failure was due to any cause beyond our reasonable control. This may include adverse weather; act of god; legislation; war; fire; flood; drought; inadequacy or unsuitability of any instructions, electronic file or other data or material; failure of power supply; lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute; or owing to any inability to procure materials required for performance of the Terms and Condition. Under such circumstances, World We Made will always do its best to aim at maintaining its Services but will not be responsible for failing to meet any obligations in the Terms and Condition.

    If World We Made breaches the Terms and Conditions we shall only be liable for losses which are direct losses and the consequence of such a breach is reasonably foreseeable. Losses shall be regarded as reasonably foreseeable where, for example, they could be contemplated by you and World We Made at the time of you placing your order, and at the time when World We Made dispatching your order. We shall only be liable for losses up to [150%] of the total value of goods purchased.

    We shall not be responsible for any or all other indirect losses. These are losses that are not caused by the breach and/or negligence on our part, and include any side effect of the main loss or damage that are not reasonably foreseeable by you and World We Made, for example, loss of profits or loss of opportunity.

    We shall not be responsible for views expressed in any media by the designers, companies or third parties whose products are sold on the Site or with whom we are associated with, as such views do not necessarily reflect ours.

    We shall not guarantee that the use of the Site and Services will be error-free or that the Site or the servers will be free of viruses or other harmful software or components. We strongly recommend all users of the Site to ensure that they have the up-to-date software installed.

    You agree that you will be personally responsible for your use of the Site and for all your communications and activities on and pursuant to the Site. By posting on the Site, you agree to be solely responsible for the content of all information you contribute. You also grant a right to World We Made to use any content you provide for its own purposes including republication in any form or media.

    As the Site is available to the general public, information which you consider to be confidential should not be posted to the Site.

  14. INDEMNITY AND WAIVER

    You agree to hold us World We Made (including its officers, directors, agents, affiliates, licensors, and suppliers) harmless from, defend us and compensate us fully, immediately upon our request, against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms and Conditions on your part.

    This includes the use of the Site by any other persons using your account as a result of your action or inaction.

    If you breach the Terms and Conditions and we take no action against you, it shall not constitute as waiver for us to exercise our rights and remedies in any other situation where you breach the Terms and Conditions.

    No waiver by us of any of these provisions of the Terms and Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

    World We Made respects the intellectual property rights of others. If you have sufficient reason to believe that your work may have been used in the Site without your permission, please contact us following this complaints handling procedure mentioned above.

  16. GOVERNING LAWS AND JURISDICTION

    The Terms and Conditions, together with all our policies and procedures are governed by and construed in accordance with the law of Hong Kong Special Administrative Region. The relevant courts of Hong Kong Special Administrative Region will have exclusive jurisdiction in the event of any dispute or claim associated with the Terms and Conditions.
